Abstract

Penelitian skripsi ini bertujuan untuk memaparkan serta mendokumentasikan dinamika perlawanan kelompok intelektual di Indonesia terhadap Undang-Undang Badan Hukum Pendidikan (UU BHP) sejak 2008 hingga 2010. Selain itu, penelitian ini juga bertujuan untuk memaparkan peran kelompok intelektual dalam memberikan wacana alternatif terkait akses pendidikan tinggi yang emansipatoris di Indonesia. Dalam proses penelitian, penulis menggunakan metode penelitian sejarah yang terdiri dari heuristik, kritik, dan interprestasi. Penulis mengumpulkan berbagai sumber, baik primer maupun sekunder, dalam tahap heuristik. Sumber primer pada penelitian ini berupa arsip laporan, seperti koran dan majalah, yang disiarkan oleh berbagai media nasional pada tahun 2003 hingga 2010. Sumber sekunder pada penelitian ini didapat menggunakan berbagai buku pendukung yang membahas tentang liberalisasi pendidikan di Indonesia, UU BHP, dan gerakan penolakan terhadap UU BHP. Data yang ditemukan nantinya melalui tahapan kritik sumber. Kemudian, penulis melakukan interpretasi serta menulis secara kronologis mengenai dinamika perlawanan kelompok intelektual di Indonesia terhadap UU BHP sejak 2008 hingga 2010. Hasil dari penelitian ini menunjukkan bahwa gerakan penolakan terhadap UU BHP di Indonesia sudah dimulai sejak awal 2000-an, tepatnya ketika UU Sisdiknas yang terbit pada 2003 mencantumkan tentang dibutuhkannya undang-undang yang secara khusus mengatur tentang badan hukum pendidikan. Bagi kelompok yang menolak, mereka khawatir bahwa UU BHP dapat melepaskan tanggung jawab pemerintah terhadap pendidikan karena perguruan tinggi didorong untuk mandiri dalam hal pembiayaan. Keberhasilan kelompok intelektual dalam menggagalkan UU BHP tidak ditempuh melalui cara yang mudah dan instan. Selama tujuh tahun, kelompok intelektual yang memiliki kesadaran akan pentingnya pendidikan murah terus berjuang secara massif dan terorganisir hingga akhirnya UU BHP dibatalkan oleh MK pada 2010. Apart from that, this research also aims to explain the role of intellectual groups in providing alternative discourse regarding access to higher education. emancipatory in Indonesia. In the research process, the author uses historical research methods consisting of heuristics, criticism and interpretation. The author collects various sources, both primary and secondary, in the heuristic stage. Primary sources in this research are archived reports, such as newspapers and magazines, which were broadcast by various national media from 2003 to 2010. Secondary sources in this research were obtained using various supporting books that discuss the liberalization of education in Indonesia, the BHP Law, and the resistance movement. against the BHP Law. The data found will later go through the source criticism stage. Then, the author interprets and writes chronologically about the dynamics of resistance by intellectual groups in Indonesia to the BHP Law from 2008 to 2010. The results of this research show that the movement to reject the BHP Law in Indonesia began in the early 2000s, precisely when the National Education System Law, which was published in 2003, included the need for a law that specifically regulates educational legal entities. For groups who refuse, they are worried that the BHP Law could abdicate the government's responsibility for education because universities are encouraged to be independent in terms of funding. The success of intellectual groups in thwarting the BHP Law was not achieved through easy and instant means. For seven years, intellectual groups who were aware of the importance of cheap education continued to fight massively and in an organized manner until finally the BHP Law was annulled by the Constitutional Court in 2010.
