Abstract
Penelitian ini bertujuan untuk mengetahui bagaimana peran Balai Pemasyarakatan (BAPAS) dalam Melindungi Hak-Hak Asasi Anak yang Berhadapan Hukum (ABH). Selain itu juga penulis ingin mengetahui Faktor Internal dan Eksternal yang mempengaruhi Peran BAPAS dalam Melindungi Hak-Hak Anak Berhadapan Hukum (ABH). Penelitian ini penting dilakukan untuk mengetahui di dalam proses hukumnya ABH ini dilindungi hak-hak mereka, sehingga di dalam proses hukumnya mengutamakan kepentingan terbaik bagi ABH. Penelitian ini menggunakan pendekatan kualitatif. Subjek penelitian adalah Pembimbing Kemasyarakatan (PK) dan ABH kasus Pencurian. Lokasi penelitian berpusat di Balai Pemasyarakatan (BAPAS) Kelas I Jakarta Timur-Utara. Teknik pengumpulan data menggunakan data primer dan sekunder. Penelitian ini dilakukan selama 3 (tiga) bulan terhitung dari bulan Januari 2019 hingga Maret 2019. Hasil penelitian ini menemukan bahwa peran BAPAS dalam melindungi hak ABH adalah melakukan pendampingan pada tahap pra adjudikasi, kemudian pendampingan di Kejaksaan dan Pengadilan pada tahap adjudikasi, dan pembimbingan pada tahap post adjudikasi. Dari tugas dan peran BAPAS untuk melindungi hak-hak asasi anak berhadapan hukum, masih belum berperan dengan maksimal. Hal ini dikarenakan factor internal yaitu fungsi administrative management di BAPAS Kelas I Jakarta Timur-Utara yang masih belum berjalan dengan baik. Selain itu adanya factor eksternal yang menghambat tugas dan peran BAPAS, sehingga hak-hak ABH masih belum terlindungi. Berdasarkan analisis SWOT dan matriks SWOT disimpulkan kurang maksimalnya peran BAPAS Kelas I Jakarta Timur Utara ini juga diakibatkan masih lemahnya kekuatan yang dimiliki oleh BAPAS dalam menghadapi ancaman dan mendapatkan peluang yang ada. This study aims to find out how the role of Penitentiary (BAPAS) in Protecting the Rights of Children Against the Law (ABH). In addition, the authors also want to know the Internal and External Factors that influence the role of BAPAS in Protecting Children's Rights Against the Law (ABH). This research is important to know in the legal process of ABH that their rights are protected, so that in the legal process prioritizes the best interests of ABH. This research uses a qualitative approach. The subjects of the study were the Community Guidance (PK) and the theft case theft. The research location is centered at Class I Correctional Institution (BAPAS), East-North Jakarta. Data collection techniques using primary and secondary data. This research was conducted for 3 (three) months from January 2019 to March 2019. The results of this study found that the role of BAPAS in protecting the rights of ABH is to provide assistance at the pre-adjudication stage, then assistance at the Prosecutor's Office and the Court at the adjudication stage, and mentoring at the post adjudication stage. From the task and role of BAPAS to protect children's rights against the law, it still has not played a maximal role. This is due to internal factors, namely the administrative management function at BAPAS Class I East-North Jakarta, which is still not going well. In addition, there are external factors that hinder the duties and role of BAPAS, so that the rights of ABH are still not protected. Based on the SWOT analysis and the SWOT matrix, it is concluded that the role of BAPAS Class I North East Jakarta is less than the maximum due to the weak strength of BAPAS in facing threats and gaining opportunities.
