Abstract

Penelitian ini dimaksudkan untuk melakukan evaluasi implementasi kebijakan sistem pengawasan ketenagakerjaan di Provinsi Jawa Barat setelah diterbitkannya Undang-undang nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Metode yang digunakan adalah deskriptif explanatory dengan pendekatan kualitatif deskriptif dengan menggunakan Model Evaluasi CIPP yang dikembangkan oleh Stufflebeam. Teknik pengumpulan data menggunakan observasi, wawancara, forum grup diskusi (FGD) dan dokumentasi. Teknik analisis data dalam penelitian ini menggunakan model analisis interaktif. Hasil penelitian ini menunjukan bahwa implementasi kebijakan sistem pengawasan ketenagakerjaan belum berjalan secara optimal antara lain karena dari sisi kontek terdapat perdebatan terkait landasan hukum penyelenggaraan pengawasan ketenagakerjaan. Dari sisi masukan yaitu sumber daya pengawasan ketenagakerjaan yang sangat terbatas, seperti jumlah dan profesionalisme pegawai pengawas ketenagakerjaan yang rendah, mekanisme pengawasan ketenagakerjaan masih bersifat konvensional dan anggaran pengawasan ketenagakerjaan yang masih rendah. Dari sisi proses yaitu pelaksanaan pengawasan ketenagakerjaan masih bersifat konvensional Sedangkan dari sisi output (hasil) yaitu belum optimal penerimaan dan penerapan secara bersama (tripartite) norma ketenagakerjaan oleh pengawas ketenagakerjaan, pengusaha, dan pekerja. Akibatnya, masih banyak pelanggaran norma ketenagakerjaan dan kejadian kecelakaan kerja. Oleh sebab itu, disamping perlu peningkatan Sumber Daya Manusia secara kuantitas dan kualitas serta kecukupan anggaran, perlu penyempurnaan mekanisme pengawasan dan dukungan sarana kerja berupa perangkat informasi (Information), komunikasi (Comunication), dan teknologi (Tegnology). *********** This research is intended to evaluate the implementation of the labor inspection system policy in West Java Province after the issuance of Law Number 23 of 2014 concerning Regional Government. The research methodology used is descriptive explanatory with descriptive qualitative approach using the CIPP Evaluation Model developed by Stufflebeam, while the methods of data collection in this research are including observation, interviews, and documentation. The data analysis techniques in this research uses an interactive analysis model. The results of this study indicate that the implementation of labor inspection system policies has not been running optimally, partly because of the context of the debate regarding the legal basis for the implementation of labor inspection. From the input side, there are very limited labor inspection resources, such as the number and professionalism of labor inspector employees, labor inspection mechanisms are still conventional and labor inspection budgets are still low. From the aspect of the process, namely the implementation of labor inspection is still conventional. While in terms of output that is not optimal acceptance and application together (tripartite) labor norms by labor inspectors, employers, and workers. This resulted in many violations of labor norms and work accidents that occurred in West Java Province. Therefore, besides increasing the Human Resources in terms of quantity and quality as well as the adequacy of the budget, the government also need to improve the mechanism of supervision and to support the work facilities in the form of information, communication, and technology equipments.
