Abstract

Penelitian ini secara garis besar mempunyai dua tujuan. Pertama, untuk mengetahui latar belakang praktik pelarangan buku di Indonesia era demokrasi serta menjelaskan peran dan motif aktor dalam melakukan pelarangan serta pemusnahan buku. Kedua, penelitian ini juga berusaha menjelaskan mengenai kredibilitas UU No.4/PNPS/1963 dan UU No.16 tentang Kejaksaan dalam konteks UUD 1945 Pasal 28 serta iklim demokrasi di Indonesia terutama pasca reformasi 1998. Penelitian ini dilakukan menggunakan metode kualitatif dengan pendekatan analisis wacana kritis. Data yang diambil berupa literatur yakni, dokumen, teks, buku dan data lainya yang kredibel dan berfokus kepada buku-buku yang dilarang pasca reformasi 1998, khususnya pada buku “Lekra Tak membakar Buku: Suara senyap Lembar Kebudayaan Harian Rakyat 1950-1965” serta “Dalih pembunuhan Masal G30S & Kudeta Suharto”. Penelitian ini dilakukan dalam rentang waktu Februari 2016 - Agustus 2016 Penelitian ini memperlihatkan bagaimana bentuk pelarangan buku masih terjadi di era demokrasi, paraktik pelarangan yang dilakukan merujuk peraturan UU No.4 PNPS tahun 1963 sebagai acuan dan payung hukum untuk menjalankan praktik-praktik pelarangan buku di era demokrasi. Kredibilitas Undang-Undang tersebut dipertanyakan, karena isi UU No.4/PNPS/1963 dianggap tidak relevan dalam iklim demokrasi saat ini dan dianggap beririsan dengan UUD 1945 pasal 28 yang mengatur tentang HAM. Sebagai upaya menjaga demokrasi, penulis serta beberapa elemen penggiat buku melakukan banding ke Mahkaman Konstitusi terhadap kredibilitas dari UU No.4/PNPS/1963 pada tahun 2010. Hasilnya, MK mengabulkan gugatan tersebut dan memutuskan penghapusan undang-undang tersebut, terkait hal itu pelarangan buku harus menjalani prosedur melalui jalur pengadilan terlebih dahulu, dan pihak kejaksaan tidak diperkenankan melakukan penarikan buku secara sepihak. This research has two objectives outline, First, to know the background of the practice of banning books in Indonesian democratic era and describe the roles and motives of the actors to ban and extermination of books. Second, this research also to explain the credibility UU No.4/PNPS/1963 and UU No.16 about on the Prosecutor in the context of UU 1945 article 28 and the climate of democracy in Indonesia, especially after the 1998 reform. This research was conducted using qualitative method with a critical discourse analysis approach. The captured data in the form literature such as documents, texts, books and other data is credible and focused on the books banned after the 1998 reform, especially on book “Lekra Tak membakar Buku: Suara senyap Lembar Kebudayaan Harian Rakyat 1950-1965” and “Dalih pembunuhan Masal G30S & Kudeta Suharto”. The research was conducted in time span of February 2016 - August 2016. This research shows how the shape of book banning is still going on in the era of democracy, banning practices that do refer to regulations UU No.4 PNPS 1963 as a reference and a legal umbrella to run practices banning of books in the era of democracy. Credibility of the Act in questionable because the contents UU No.4/PNPS/1963 it is not relevant to the current climate of democracy and considered to intersect with UUD 1945 article 28 regulate about HAM. As an effort to maintain democracy, authors as well as some elements of the instigators of the book to appeal to the Supreme Court of the Constitution to credibility of UU No.4/PNPS/1963 in 2010. As a result, the Court granted the lawsuit and decided the abolition of these law, related to the banning of books must undergo the procedure go through the courts in advance, and the prosecution is not allowed to withdraw unilaterally books.
