Abstract

ANNISA NURUL HIDAYAH SURYA. Gerakan Perempuan Mendorong Penghapusan Kekerasan Dalam Rumah Tangga di Indonesia (1997-2004). Skripsi. Jakarta. Program Studi Pendidikan Sejarah. Fakultas Ilmu Sosial. Universitas Negeri Jakarta. 2023. Penelitian ini bertujuan untuk mendeskripsikan upaya gerakan perempuan melawan kekerasan domestik, strategi advokasi gerakan perempuan yang berlandaskan Teori Hukum Feminis (Feminist Legal Theory), dan tantangan yang dihadapi para aktivis perempuan dalam proses tersebut, khususnya pada 1997-2004. Periode ini merupakan masa pengeksekusian atas kesadaran kolektif aktivis perempuan soal Kekerasan Dalam Rumah Tangga (KDRT) yang semakin marak terjadi, yaitu dengan melakukan advokasi kebijakan. Sampai pada 22 September 2004, advokasi kebijakan yang intens dilakukan oleh aktivis perempuan di Indonesia berbuah manis. Rancangan Undang-undang yang diusung, akhirnya disahkan menjadi UU yang diharapkan dapat memberikan keadilan bagi para korban KDRT—yang mayoritas adalah perempuan. Penelitian ini menggunakan metode historis, terdiri dari empat langkah yaitu heuristik atau pengumpulan sumber sejarah, verifikasi, interpretasi, dan historiografi atau penulisan sejarah. Hasil dari penelitian ini menunjukkan bahwa pergerakan perempuan di Indonesia berhasil mempengaruhi transformasi Undang-undang dan norma sosial terkait kekerasan domestik di Indonesia. Pergerakan perempuan, melalui strategi advokasi kebijakannya, telah mendorong perubahan persepsi mengenai kekerasan domestik dari masalah pribadi menjadi masalah publik yang membutuhkan intervensi hukum. Lebih dari inisiatif pemerintah, gerakan perempuan berjuang untuk perlindungan dan pemulihan yang adil bagi korban. Pergerakan perempuan memanfaatkan media dan teknologi untuk menjangkau audiens yang lebih luas dan mendapatkan dukungan publik. Meskipun menghadapi resistensi dari kelompok konservatif dan hambatan budaya, gerakan ini tetap bertahan, memanfaatkan aliansi strategis, dan peluang politik. Hal ini mencerminkan kekuatan gerakan akar rumput dalam menghasilkan perubahan sosial dan hukum yang substansial. Selain itu, penelitian ini menunjukkan urgensi pemerintah dan Dewan Perwakilan Rakyat (DPR) agar melibatkan perempuan dalam penyusunan setiap regulasi yang akan berdampak pada perempuan. Hal ini agar memasukkan pengalaman perempuan korban kekerasan, supaya keadilan dapat diraih korban. State University of Jakarta. 2023 This research aims to describe the efforts of the women's movement against domestic violence, advocacy strategies of the women's movement based on Feminist Legal Theory, and the significant role of the women's movement in developing pro-women regulations, as well as the challenges faced by female activists in the process, particularly from 1997 to 2004. This period was a time of execution of collective awareness of female activists about Domestic Violence (DV) which was increasingly rampant, namely by conducting policy advocacy. Until September 22, 2004, policy advocacy intensively conducted by female activists in Indonesia showed good results. The proposed law that was endorsed finally became a law that is expected to provide justice for DV victims—who are predominantly women. This study uses historical methods, consisting of four steps, namely heuristic or the collection of historical sources, verification, interpretation, and historiography or historical writing. The results of this study indicate that the women's movement in Indonesia succeeded in influencing the transformation of laws and social norms related to domestic violence in Indonesia. The women's movement, through its policy advocacy strategy, has pushed for a change in perception of domestic violence from a private matter to a public issue that requires legal intervention. More than a government initiative, the women's movement fought for fair protection and recovery for victims. The women's movement utilized media and technology to reach a wider audience and gain public support. Even though they faced resistance from conservative groups and cultural obstacles, this movement persisted, leveraging strategic alliances and political opportunities. This reflects the strength of grassroots movements in producing substantial social and legal changes. In addition, this research shows the urgency of the government and House of Representatives to involve women in the preparation of every regulation that will impact women. This is to incorporate the experiences of women victims of violence, so that justice can be achieved for the victims.
