Abstract

Penelitian ini bertujuan untuk menganalisis peran Komnas Perempuan terhadap perempuan yang menjadi korban kekerasan seksual dan Pemerkosaan Tragedi Mei 1998 dalam kurun waktu 1998 hingga 2008. Metode yang digunakan dalam penelitian ini adalah metode historis yang meliputi proses menguji dan menganalisa segala fakta dan peninggalan masa lampau secara kritis. Hasil dari penelitian ini menjelaskan bahwa Tragedi Mei 1998 tidak hanya terjadi aksi penjarahan dan pembakaran, tetapi terjadi pula kekerasan kekerasan yang mayoritasnya korbannya adalah perempuan Tionghoa. Para perempuan mengalami kekerasan seksual bahkan pemerkosaan selama kurun waktu 13-15 Mei 1998. Sebagai respon dan upaya tanggung jawab, pemerintah Indonesia mendirikan Komnas Perempuan melalui Keputusan Presiden No. 181/1998. Komnas Perempuan menjadi lembaga negara pertama yang didirikan pada masa reformasi sebagai wadah perlindungan hak asasi perempuan di Indonesia. Oleh karena itu, Komnas Perempuan memiliki berbagai peran dalam upaya penyelesaian kasus kekerasan perempuan di Indonesia, termasuk kekerasan seksual dan pemerkosaan Mei 1998. Walaupun penyelesaian secara hukum mengalami kebuntuan hingga saat ini, Komnas Perempuan tetap berupaya mengisi ruang-ruang yang dapat dijalankannya sebagai upaya pemenuhan hak-hak para korban melalui investigasi dan pemantauan, advokasi dengan berbagai pihak, kajian dan dokumentasi, serta pengembangan sistem layanan korban kekerasan. ***** The purpose of this research is to analyze the role of Komnas Perempuan towards women who were victims of sexual violence and rape in the 1998 May Tragedy from 1998 to 2008. The method used in this research is the historical method which includes the process of critically examining and analyzing all facts and relics of the past. The results of this study explain that the May 1998 Tragedy did not only occur looting and burning, but also violent violence, the majority of which were Chinese women. The women experienced sexual violence and even rape during the period of May 13-15, 1998. As a response and an effort to take responsibility, the Indonesian government established Komnas Perempuan through Presidential Decree No. 181/1998. Komnas Perempuan became the first state institution established during the reformation period as a forum for the protection of women's human rights in Indonesia. Therefore, Komnas Perempuan has various roles in efforts to resolve cases of violence against women in Indonesia, including sexual violence and rape in May 1998. Although the legal settlement has been deadlocked until now, Komnas Perempuan still tries to fill the spaces that it can run as an effort to fulfill the rights of victims through investigation and monitoring, advocacy with various parties, studies and documentation, and the development of a service system for victims of violence.
