Abstract

Hak Asasi Manusia (HAM) pada dasarnya merupakan anugerah yang bersifat kodrati pemberian Tuhan Yang Maha Esa yang perlu dilindungi. Perlindungan hak tersebut termasuk dalam aspek hak sipil dan hak politik.Hak sipil dan politik tersebut beberapa diantaranya, yaitu hak atas hidup dan hak atas kebebasan berpikir dan menyampaikat pendapat di muka umum. Tujuan penelitian ini untuk mengetahui terjadinya proses Aksi Demonstrasi 24 September 2019 di Jakarta dan untuk mengetahui pelaksanaan perlindungan Hak Asasi Manusia (HAM) dalam aspek hak politik mahasiswa sebagai massa yang mendominasi dalam aksi demonstrasi 24 September 2019 di Jakarta. Metode yang digunakan dalam penelitian ini menggunakan pendekatan kualitatif secara deskriptif. Teknik pengumpulan data dalam penelitian ini dilakukan melalui wawancara dengan informan, pengumpulan dan analisis dokumen, serta studi literatur pada buku, jurnal, berita, laporan serta catatan dan data resmi dari lembaga independen terkait. Hasil penelitian menunjukkan adanya perlindungan Hak Asasi Manusia (HAM) oleh aparat kepolisian dalam aspek hak politik dengan bukti massa aksi demonstrasi dapat menyelenggarakan aksi tersebut secara damai dan mendapatkan pengamanan aksi demonstrasi dari aparat kepolisian agar terciptanya rasa aman pada mahasiswa yang menyampaikan pendapatnya di muka umum, sehingga mahasiswa dapat menyalurkan seluruh aspirasi dan tuntutannya. Aksi demonstrasi tersebut berlangsung kondusif hingga sore hari dan diikuti oleh ratusan ribu mahasiswa. Aksi demonstrasi 24 September 2019 di Jakarta awalnya hanya merupakan seruan aksi di media sosial dan menjadi sebab terciptanya aksi demonstrasi secara langsung di depan Gedung DPR RI Senayan. Selain itu, kesesuaian tindakan aparat kepolisian dengan aturan perlindungan Hak Asasi Manusia (HAM) dalam aspek hak politik pada mahasiswa dibuktikan dengan tidak adanya tindakan menghalangi dari aparat kepolisian kepada mahasiswa yang akan berkumpul ke titik aksi demonstrasi sehingga hak bebas dalam berserikat, berkumpul, dan menyatakan pendapat di muka umum dapat dijunjung tinggi perlindungannya. Human Rights is a natural gift from God that needs to protect.The protection of the rights including on civil rights and political rights Those civil dan political rights including, the right to life and the right to freedom of think and freedom of speech. This study purposed to know the process of 24th September 2019 Demonstration in Jakarta and to know implementation of the protection of Human Rights in the political rights aspects of college students as the mass who dominate at 24th September 2019 Demonstration in Jakarta. This study used the method of qualitative approach in descriptive. Data collection techniques in this study collected by interviewed with 6 informants, documents collection and analysis, and study of literature on the books, journal, news, report, and official file and data from related independent institutions. The result of this study shows there are protection of the political right that showed by mass can organize the demonstration and get the security by the police in order to created the college student’s sense of secure that express their opinion in public. The Demonstration occurred until the evening and followed by hunreds of thousand college student. The 24th September 2019 Demonstration in Jakarta starting from the call of movement on social media and causing the creation of mass demonstration in front of the Indonesia parliament building Senayan. Furthermore, the suitability of action by the police with the rules of protecting the political rights of college students showed by there is not restriction by the police to college student that will gather at location of demonstration so the rights of unified, gather, and express the opinion in public could be upheld the protection of its rights.
