Abstract

Tujuan dari penelitian ini yaitu untuk mengetahui bagaimana proses Unit Pelayanan Perempuan dan Anak dalam menangani kasus anak pelaku tindak pidana di Kepolisian Resor Jakarta Timur dan bagaimana upaya Unit PPA dalam memenuhi Hak Anak sebagai pelaku tindak pidana Metode penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan studi deskripstif. Penelitian ini menggunakan sumber data primer dan sekunder. Tekhnik pengumpulan data primer dilakukan dengan cara melakukan wawancara dengan 3 (tiga) petugas Unit PPA sebagai Informan, 1 (satu) Ketua Unit PPA sebagai Key Informan, serta 1 (satu) Dosen Hukum Universitas Syarif Hidayatullah ( UIN ) Jakarta sebagai Expert. Hasil penelitian menunjukan bahwa adanya proses penyidikan pada Unit Pelayanan Perempuan dan Anak di Polres Jakarta Timur, yaitu : 1. Penangkapan paling lama 24 jam, 2. Anak di tempatkan di ruang khusus anak, 3. Anak harus di rahasiakan identitasnya, 4. Petugas dilarang menggunakan atribut kedinasan, 5. Adanya proses Keputusan Bersama untuk anak berusia di bawah 12 tahun, dan proses Diversi/ Restorative Justice bagi anak yang berusia di atas 12 tahun. Untuk pemenuhan hak-hak anak dalam kasus tindak pidana pada Unit PPA Polres Jakarta Timur, yaitu dengan diberikannya pendamping penasihat hukum. Anak berhak memilih pendamping, baik pendamping yang ditunjuk langsung oleh Negara atau BAPAS, atau dari pihak pribadi, selama proses penyidikan berlangsung anak akan di titipan di balai rehabilitasi sosial anak memeerlukan perlindungan khusus, dan disana juga anak mendapatkan hak mempunyai kehidupan yang layak, hak mendapatkan pendidikan dan mendapatkan orang tua asuh. Kesimpulan dari penelitian, menunjukan bahwa proes penanganan Anak sebagai pelaku tindak pidana di Polres Jakarta Timur memakai penyidikan khusus anak. Sedangkan pemenuhan hak-hak anak dalam kasus tindak pidana pada Unit PPA Polres Jakarta Timur, yaitu dengan diberikannya penasihat hukum sebagai pendamping selama proses penyidikan. *********************** The purpose of this study is to study how the process of the Women's and Children's Service Units in dealing with children as perpetrators of crime in the East Jakarta District Police and also how the PPA Unit in fulfilling the rights of children as perpetrators of crime This research method uses qualitative research methods with descriptive studies. This research uses primary and secondary data sources. Primary data collection is done by conducting interviews with 2 (three) PPAd Unit officers and 1 (one) Lawyer from the PPA Unit as an Informant, 1 (one) Head of the PPA Unit as a key informant, and 1 (one) Lecturer in Criminal Law at Syarif Hidayatullah University ( UIN) Jakarta as Expert. The results showed that there was an investigation process in the service unit for women and children at the East Jakarta Police, namely: 1. Arrest for a maximum of 24 hours, 2. The child was placed in a special room for children, 3. The identity of the child must be kept secret, 4. Officers are prohibited from using official attributes, 5. There is a joint decision-making process. for children under 12 years, and the Diversion and Restorative Justice process for children over 12 years. Fulfilling children's rights in criminal cases at the PPA Polda Metro Jaya Unit is by providing legal companions. The child has the right to choose a companion, either a companion appointed directly by the State or BAPAS, or from the private sector, during the investigation process the child will be entrusted to a special beach for child rehabilitation, and that is where the child gets the right to live properly, the right to get education and get a person foster parents. The conclusion of this study is that the handling of children as perpetrators of criminal acts at the East Jakarta Police uses a special investigation against children. Meanwhile, the fulfillment of children's rights in criminal cases at the PPA Unit of the East Jakarta Police is to provide legal companions as a companion during the investigation process.
