Abstract

Tujuan dari penelitian ini adalah untuk mengetahui penyebab pengemudi yang berstatus siswa di bawah umur pada SMA Negeri 31 Jakarta memilih moda transportasi kendaraan bermotor pribadi, mengetahui kesadaran hukum para siswa di bawah umur yang mengendarai kendaraan bermotor ke sekolah pada SMA Negeri 31 Jakarta, dan mengetahui sikap pihak sekolah terkait siswa di bawah umur pada SMA Negeri 31 Jakarta yang mengendarai kendaraan bermotor ke sekolah. Metode penelitian yang digunakan dalam penelitian ini ialah kualitatif deskriptif dengan teknik pengambilan data yakni wawancara, observasi, dan dokumentasi. Wawancara dilakukan kepada 10 informan yang merupakan siswa di bawah umur pada SMA Negeri 31 Jakarta yang mengendarai kendaraan bermotor ke sekolah, key informan yakni Wakil Kepala Sekolah Bidang Kesiswaan SMA Negeri 31 Jakarta, dan informan tambahan yakni penjaga tempat parkir. Hasil yang diperoleh dari penelitian ini yaitu, pertama penyebab pengemudi yang berstatus siswa di bawah umur pada SMA Negeri 31 Jakarta memilih moda transportasi kendaraan bermotor pribadi dibanding moda transportasi lainnya, yakni karena lebih cepat, lebih hemat, tidak ribet, terlihat keren, bisa mengantar siswi lain, tidak lelah karena berjalan kaki, lebih enak, lebih nyaman, lebih efisien, bisa pulang bersama teman, lebih gampang dan fleksibel serta untuk menyalurkan hobi. Kedua, kesadaran hukum para informan yaitu siswa-siswa SMA Negeri 31 Jakarta tergolong rendah karena sebagian informan yang merupakan para siswa mengetahui hukum terkait UU No. 22 Tahun 2009, dan rata-rata informan yang sudah cukup baik dalam memahami isi dan tujuan dari UU No. 22 Tahun 2009. Dari sisi lain, dalam hal sikap hukum, para siswa mengabaikan peraturan hukum terkait UU No. 22 Tahun 2009 dan dalam hal perilaku hukum, para siswa belum menaati peraturan hukum terkait UU No. 22 Tahun 2009. Ketiga, sikap pihak sekolah terkait siswa di bawah umur pada SMA Negeri 31 Jakarta yang mengendarai kendaraan bermotor ke sekolah yakni pihak sekolah tidak memperbolehkan para siswa mengendarai kendaraan bermotor ke sekolah. Pihak sekolah akan menjatuhkan sanksi terhadap siswa yang ketahuan mengendarai kendaraan bermotor ke sekolah, melakukan razia dan bekerja sama dengan pihak kepolisian dalam melakukan sosialisasi terkait larangan mengendarai atau membawa kendaraan bermotor ke sekolah. The purpose of this research are to find out the reason of riders who are underage students at SMA Negeri 31 Jakarta choose the mode of transportation of private motorcycle, to know the legal consciousness of underage students who rides a motorcycle to school at SMA Negeri 31 Jakarta and to know the respond of school regarding underage students at SMA Negeri 31 Jakarta who rides a motorcycle to school. The research method used in this study is descriptive qualitative with data collection techniques namely interviews, observation, and documentation. Interviews were conducted with 10 informants who were underage students at SMA Negeri 31 Jakarta riding motorcycle to school, the key informant was the Deputy Principal for Student Affairs at SMA Negeri 31 Jakarta, and additional informants was parking guards. The results obtained from this study are, first, the reason of riders who are underage students at SMA Negeri 31 Jakarta choose the mode of transportation of private motorcycle compared to other modes of transportation, are because of they are faster, more economical, not complicated, looks cool, can take the others students, too tired of walking, more comfortable, more efficient, can go home with friends, easier, more flexible and to channel hobbies. Second, the legal consciousness of informants who are students at SMA Negeri 31 Jakarta is classified as low because some informants who are students know the laws related to UU No. 22 Tahun 2009, and the average informant are quite good at understanding the content and purpose of UU No. 22 Tahun 2009. From the other side, in terms of legal attitude, students ignore the legal regulations related to UU No. 22 Tahun 2009 and in terms of legal behavior, students have not obeyed the legal regulations related to UU No. 22 Tahun 2009. Third, the respond of the school regarding underage students at SMA Negeri 31 Jakarta who rides a motorcycle to school that is the school does not allow students to ride a motorcycle to school. The school will impose sanctions on students who are caught riding motorcycle to school, conduct raids and cooperate with the police in conducting socialization related to prohibitions on riding or bringing motorcycle to school.
